LIFETIME LIMITED MATERIAL WARRANTY

Effective Jan. 1, 2025

1. Term of Warranty

  • Limited Material Lifetime Warranty — for the lifetime of the product beginning on the date the product is shipped from the factory.
  • Solid roof panels — warranted against manufacturing defects of delaminating, cracking, peeling, or blistering for a period of ten (10) years from date of shipping.
  • Curve glass units — warranted for a period of ten (10) years from date of shipping.

2. Warranty Coverage / Eligibility

  • Warranty applies only to the ORIGINAL RETAIL OWNER/PURCHASER.
  • Warranty is not transferable.
  • "Original Owner/Purchaser" means the owner(s) of the real property upon which the solarium is originally installed who has completed and returned a warranty registration card to ALUMAVERSE, INC. within ninety (90) days of delivery of products.
  • Any unregistered product will be deemed sold "AS IS."
  • Warranty does not extend to any subsequent person or entity claiming ownership interest in the real property or the solarium.

3. Disclaimer of Other Warranties

ALUMAVERSE, INC. expressly disclaims all other warranties, oral or written, express or implied, including without limitation:

  • Warranties of merchantability
  • Warranties of fitness for a particular purpose

ALUMAVERSE, INC. disclaims any warranties given by any dealer, contractor, installer, sales representative, estimator, or distributor.

4. Scope of Warranty

Warranty covers materials only. Does not include:

  • Installation costs
  • Shipping costs

Replacement materials shall be F.O.B. the manufacturing or distribution facility designated by ALUMAVERSE, INC.

ALUMAVERSE, INC. shall not be liable for any special, indirect, incidental, or consequential damages.

5. Claim Procedure

Original Owner/Purchaser must notify ALUMAVERSE, INC. within thirty (30) days from discovery of the defect. Notice must include:

  • Specifics regarding alleged defects
  • Copy of original bill of sale or invoice

ALUMAVERSE, INC. must be given reasonable time to inspect defects. No repairs shall begin prior to inspection. ALUMAVERSE, INC. reserves the right to determine in its sole discretion whether a defect exists.

6. Company Remedies

Within one hundred and twenty (120) days, ALUMAVERSE, INC., at its sole option, may:

  • (a) Provide a replacement for the defective part;
  • (b) Repair the defective part; or
  • (c) Provide a refund based upon ALUMAVERSE, INC.'s then-current retail price for a comparable product less the following charges:
  • 1–15 years — no charge
  • Over 15 years — 50% charge

7. Exclusions and Limitations

Warranty is not effective with respect to:

  • Glass distortions or breakage
  • Insulated glass panels subject to stress from moving or settling of structure
  • Products installed above 4,000 feet above sea level
  • Products not installed according to ALUMAVERSE, INC. installation instructions
  • Products installed beyond manufacturer design limits
  • Damage from earthquake, lightning, hail, hurricane, tornado, wind-borne objects, or other acts of God
  • Damage from fire, vandalism, riot, insurrection, or civil disorder
  • Damage from harmful chemicals
  • Damage from abuse, misuse, failure to provide reasonable maintenance, or normal weathering
  • Fading or chalking of painted finish or custom paint colors
  • Staining of glass or painted surfaces caused by environmental water, salt, chemicals, or other causes
  • Products sold or installed outside continental U.S.A. or Canada
  • Commercial establishments: Warranty limited to one (1) year from date of shipping
  • Warranty is void if services rendered are not paid in full

8. Governing Law and Arbitration

Warranty governed by the laws of the State of Washington. If any provision is limited or prohibited by applicable law, remaining terms remain in effect.

Disputes regarding enforceability shall be submitted to binding arbitration:

  • American Arbitration Association or agreed arbitrator
  • Arbitration location: Vancouver, WA
  • Single arbitrator

9. Return of Defective Materials

Original Owner/Purchaser must return defective materials, shipping prepaid, after:

  • Prior notice
  • Receiving written authorization from ALUMAVERSE, INC.
