LIFETIME LIMITED MATERIAL WARRANTY
Alumaverse, the manufacturer of the solarium, provides you with the following material warranties and rights.
TERM OF WARRANTY: Our Limited Material Lifetime Warranty is for the lifetime of the product beginning on the date the product is shipped from the factory.
Solid roof panels are warranted against the manufacturing defects of delaminating, cracking, peeling or blistering for a period of ten (10) years from date of shipping.
ALUMAVERSE warranty is to the ORIGINAL RETAIL OWNER/ PURCHASER and is not transferable. This warranty is for the material hereinafter referred to as the “product”(s) only. For purposes of this warranty, the term “Original Owner/Purchaser” is defined as the owner(s) of the real property upon which the solarium is originally installed who has completed and returned a warranty registration card to Alumaverse LLC. within ninety (90) days of delivery of products. Any unregistered product will be deemed to be sold “AS IS” This warranty does not extend to any subsequent person or entity claiming ownership interest in or to the real property or the solarium.
ALUMAVERSE expressly disclaims any and all other warranties, oral or written, express or implied, including, without limitation, any warranties of merchantability or fitness for a particular purpose. Further, Alumaverse LLC. shall not be liable for, and expressly disclaims, any other warranties that may have been given, orally or in writing, by any dealer, contractor, installer, sales representative, estimator or distributor.
ALUMAVERSE warranty, as set forth herein, is for materials only and does not include any and all costs related to installation, shipping. All replacement materials shall be F.O.B. the manufacturing or distribution facility designated by Alumaverse LLC.
ALUMAVERSE shall not be liable for any special, indirect, incidental or consequential damages whether or not resulting from or caused by the negligence of Alumaverse LLC. or from any breach of the warranty set forth herein.
Original Owner/Purchaser must notify Alumaverse LLC. within thirty (30) days from the discovery of the defect. Such notice shall provide specifics regarding alleged defects, shall contain a copy of original bill of sale or invoice, and shall be delivered to ALUMAVERSE LLC. at 7402 NE St. Johns Rd #B, Vancouver, WA 98665. Alumaverse LLC. shall be given a reasonable time to inspect defect(s) and no repairs shall begin prior to such inspection. Alumaverse LLC. reserves the right to determine in its sole discretion whether a defect (s) exists. Alumaverse LLC. shall, at its sole option and within one hundred and twenty (120) days do any of the following: (a) provide a replacement for the defective part; (b) repair the defective part; or (c) provide the Original Owner/Purchaser with a refund based upon Alumaverse LLC. then-current retail price for a comparable product less the appropriate charges in the following schedule:
Amount of charge to customer: 1-15 years – none, over 15 years- 50%
This warranty is not effective with respect to Glass-distortions or breakage. Insulated glass panels subject to stress from moving or settling of structure, products installed above 4,000 feet above sea level. Products not installed in accordance with Alumaverse LLC. installation instructions or beyond design limits set by the manufacturer. Alumaverse LLC. shall not be responsible for damages from earthquake, lighting, hail, hurricane, tornado, wind borne objects or other acts of God: fire, vandalism, riot, insurrection, civil disorder, or contact with harmful chemicals, installation of unapproved by Alumaverse LLC interior roof shades, glass films, etc. abuse, misuse or failure to provide reasonable maintenance of the product or changes in the product due to the normal weathering process. Fading or chalking of any painted finish or custom paint colors. Staining of glass or any painted surface caused by environmental water, salt, chemicals or other causes. Products sold or installed outside of continental U.S.A. or Canada. This Warranty is limited to one year from the date of shipping products used or installed in commercial establishments.
This Warranty is void if services rendered are not paid in full.
This warranty shall be governed by the laws of the State of Washington. To the extent that applicable law limits or prohibits any provision of this Warranty, the remaining terms and conditions of the Warranty shall remain in full force and effect.
To the extent that any dispute arises out of the enforceability of this Warranty, or any part hereof, such dispute shall be submitted to binding arbitration with the American Arbitration Association, or such other arbitrator or arbitration organization as the parties shall agree upon, and the arbitration shall take place in Vancouver, WA before a single arbitrator.
It shall be the obligation of the original owner/purchaser to return any defective materials, shipping charges prepaid, to Alumaverse after giving prior notice and receiving written authorization from Alumaverse for such return.
Some states do not allow the exclusions of limitation of consequential damages, so the above limitation or exclusions may not apply.
